1. What is Strategic Estate Planning and why is it so important to incorporate into your Estate Plan documents?
Answer: Strategic Estate Planning is based on the concept that the language in your Trust and Estate Plan documents is just as important as having the documents themselves. Strategic Estate Planning involves inserting key statutory provisions and choices available to you in the preparation and drafting of your Estate Plan documents so that these documents will work the way you intend at the time of medical crisis. There are many options available to you such as making your Power of Attorneys effective immediately and not upon disability or incapacity. The latter requires a court order or a medical report stating your incapacity or disability before your designated agent can act for you in times of medical crisis. This causes time delay and confusion. 2. Who should I appoint as Trustee and Successor Trustee?
Answer: If you are married, usually you and your spouse will be the designated Trustees in control of your Trust and estate assets. The key is to select a Successor Trustee whom you trust to act on your behalf when both you and your spouse can no longer handle your financial affairs. As part of Strategic Estate Planning, we recommend that you consider naming two people as Successor Trustees with the connecting words of “or… each with the full power and authority to act individually and independent in such legal capacity”. These will assure one person can act if the other can not act for any reason whatsoever.
3. Who should I name as my Medical and General Power of Attorney?
Answer: Again, if you are married we recommend that you name your spouse as your Power of Attorney. However, we strongly recommend that you consider having a second person designated as your Power of Attorney with the connecting words of “or… each with the full power and authority to act individually and independent in such legal capacity”. The purpose of this choice is to provide for any circumstance where your spouse also cannot act on your behalf for any reason whatsoever. We call this Strategic Estate Planning concept “having two people in the front seat”. These ideas are for discussion purposes only but may be extremely relevant under certain future circumstances
4. Does naming my Health Care and General Durable Power of Attorneys give them complete control to act in such respective capacities upon your disability?
Answer: If drafted properly, your Agents will be able to act for you, effective immediately, without the need of court or medical involvement over your health and financial affairs. However, it should be noted that all Power of Attorneys lapse on death by law. Therefore, other legal documents are necessary to allow your family members as designated Agents to act over the management of your assets following your death.

Marc has proudly obtained his Law Degree from California Western School of Law and is a licensed attorney in California and Arizona.
A personal experience sparked mark’s motivation to excel in estate planning: “I don’t want anyone to go through the experiences I endured following my father’s death.” This event, which took place twenty years ago, shaped his practice philosophy, which he now calls “Peace of Mind.”
Having practiced law for nearly 40 years, Mark Fishbein specialized in estate planning, business and corporate planning, and asset protection planning. His legal career began with administrating his father’s estate, which inspired his focus on estate planning. Although he has retired from actively practicing law as a licensed attorney, Mark now leverages his extensive personal and professional experience to strengthen the ALTA team. After law school, Marc Fishbein took the California bar exam and passed on his first attempt. Without pause, he immediately began studying for the Arizona bar exam, which he also passed on the first attempt. This dedication to his legal career laid the groundwork for the founding of Fishbein Law Group, PLLC in 2024. Marc envisioned creating a firm that prioritizes clear communication, transparency, and a commitment to securing the best possible outcomes for clients.
